Update (8/3/2020): Last week on July 29th, 2020, a federal judge granted a nation-wide injunction and blocked the public charge rule from being implemented during the COVID-19 public health crisis.
Update (1/31/2020): Today the USCIS announced an effective date for the agency’s public charge rule. The final rule will only apply to applications and petitions submitting on or after February 24, 2020 (except for in the State of Illinois). DHS will not consider an immigrant’s receipt of the newly listed benefits before February 24, 2020 in the public charge determination. Update (1/27/2020): Today, the U.S. Supreme Court set aside the preliminary injunction from New York that prevented the Department of Homeland Security (DHS) public charge rule from taking effect nationwide. This was the last of the three district court nationwide injunctions standing, which means that the DHS rule can go into effect nationwide, except in Illinois where it is blocked by a statewide injunction. This means that in California the public charge rule will be allowed to go into effect while the litigation continues. We will know soon when exactly the rule will be implemented. Update (10/22/19): Shortly before it was set to take effect on October 15th, five federal districts courts, sitting in California, Washington, Baltimore, Cook County, and New York City issued preliminary injunctions against the Trump Administration’s public charge rule, halting at least for now a rule that was widely expected to reduce access to public benefits for immigrant communities.
